Hey Standard! Contest – Official Rules

DESCRIPTION OF THE CONTEST: NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER THIS CONTEST.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  By participating in the Contest, you agree to these Official Rules.  This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Line or any other social media site.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor, not Facebook, Instagram, Line or any other social media site.    

SPONSOR: The Contest is sponsored by Standard Asia Co., Ltd. located at 59 Soi Rim Khlong Phra Khanong, Phra Khanong Nuea, Vadhana, Bangkok 10110 (“Sponsor”). 

ELIGIBILITY: The Contest is open only to legal residents of the Kingdom of Thailand (the “Participants”).  Entries by minors may only be submitted with the permission of a parent or legal guardian.  Parents or Legal Guardians authorizing submission of the Entries must be over 21 years of age at the time of submission and a legal resident of the Kingdom of Thailand.  Employees, officers and contractors of (1) Sponsor, hotels under Sponsor’s family of brands, or Etihad Airways (“Prize Partner”) and (2) their respective parent companies, affiliates and subsidiaries, and their immediate families (defined as parents, children, siblings and spouse, regardless of where they reside, and/or those living in the same household of each) are not eligible to participate in the Contest. 

HOW TO ENTER: Participants (if a minor, with consent from their parent or legal guardian) may enter the Contest from July 20, 2022, starting at 12:00pm, through August 15, 2022 Indochina Time (ICT)  (the “Entry Period”).  There is only one (1) method of entry, ONLINE by fully complying with all the following steps:

(1)         Like and share the Facebook post announcing the Contest by tagging 1 or more friends (and set public)

(2)         Follow the Facebook and Instagram accounts for The Standard, Bangkok Mahanakhon and The Standard, London, at the following links:

(4)         Provide on Sponsor’s landing page regarding the Contest, available at https://bangkok-to-london.splashthat.com (“Landing Page”), Participant’s name, email address, postal code, birthday, Facebook, Instagram and confirmation of adding LINE account

(5)         Provide on the Landing Page a creative response to the question:  “Why do you deserve a luxury trip this year?” in either Thai language or English language

All of the above must be completed in order to submit the entry into the contest (collectively “Entry” or “Entries”).

By entering, Participants will be providing their above information to Sponsor.  There is a limit of one (1) Entry per person during the duration of the Entry Period.  Sponsor is not responsible for any lost, late, delayed, illegible, incomplete, or misdirected Entries.  Incomplete, unreadable or late Entries will be disqualified. 

If Participants choose to participate using their mobile phone, standard data fees may apply.  Other than for prize notification or for promotional emails, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any Participant regarding this contest or acknowledge any Entry not meeting all Entry requirements stated herein & such Entries will be disqualified.  By entering this contest, Participants give their express permission to be contacted by Sponsor, Prize Partner and agents acting on their behalf by email for the purpose of this Contest only. 

Participants’ Facebook account must be public in order to be eligible.  By following the above steps in connection with Facebook post, Participants acknowledge and agree that the Sponsor has the right to stream Participants’ post through the Facebook’s API or otherwise their posts as set forth in its online Terms and Conditions at https://www.facebook.com/policy.php.

Each Entry must meet the following “Entry Requirements” or Entry will be disqualified: (i) the Entry must not contain any person other than the Participant; (ii) the Entry must be submitting Participant’s original, and not include any material created, owned or controlled by third parties (including without limitation, third party copyrighted material) and may not have been entered in any other contest or considered for any award; (iii) the Participant must provide upon request all appropriate clearances, permissions and releases for the Entry (in the event an Participant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Entry, or seek to secure the releases and clearances for Sponsor’s benefit, or allow the applicable Entry to remain in the Contest); (iv) the Entry must not include any content that is obscene, pornographic, libelous, against public order or otherwise objectionable or illegal; and (v) each Entry must be uniquely different.  Any Entry that, in Sponsor's good faith and sole judgment, violates the Entry Requirements may be disqualified. 

CONTEST ENTRY ASSIGNMENT OF RIGHTS:  Participants warrant and represent that (1) Sponsor shall own the Entry (and all material and rights embodied therein) regardless the outcome of the Entry; and (2) that by entering, the Participant automatically, irrevocably and unconditionally assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (3) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, reproduce, publish, exploit and use the Entry in any way and in any and all media now known or hereinafter discovered or devised, world-wide for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to Participants or any third parties.  Participants further agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding. 

CONTEST ENTRIES JUDGING: All eligible Entries received within the Entry Period will be judged within seven (7) days following the Entry Period’s conclusion based on the following criteria by a panel of judges designated by Sponsor to select the top scoring one (1) Entry for the Entry Period. 

JUDGING CRITERIA:  Creativity of the response to the question “Why do you deserve a luxury trip this year?” (0-100 points)

The one (1) Entry (with the highest point total for the Entry Period will be deemed a potential Prize.  Winning a prize is subject to verification of eligibility and compliance with these Official Rules.  Sponsor reserves the right to select fewer than one (1) Entry for the Entry Period if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries.  In the event of a tie, a separate tie-breaking judge or judging panel determined by Sponsor at Sponsor’s sole discretion will re-judge the tied Entries based on the above Judging Criteria.

The winner (or parent or legal guardian of the winner) will be contacted through their email address, Facebook, Instagram or LINE accounts provided via the Landing Page and may be required to execute and return any paperwork required by Sponsor within three (3) days of date of issuance of notification.  In the event of noncompliance with these Official Rules or the determination that the potential winner fails to properly complete and submit the above-described documents, Sponsor may disqualify such potential winner and, at Sponsor’s discretion, another Participant may be notified that such Participant is a potential Prize winner. 

PRIZE DESCRIPTION AND CONDITIONS:  A prize package for the winner will consist of the following (“Prize”): 

·       2 roundtrip business class tickets from Bangkok, Thailand, to London, England, on Etihad Airways for winner and one adult travel companion (“Flight Tickets”)

·       A voucher for a three (3)-night stay at The Standard, London, for winner and one adult travel companion in a Standard King of Kings room (double-occupancy).  Sponsor will attempt to accommodate winner’s preferred dates of stay, but all specifics thereof will be at Sponsor’s sole discretion.

·       A credit in the amount of Thai Baht 5,000 for use at food and beverage venues at The Standard, Bangkok Mahanakhon (“F&B Credit”).     

Hotel stay must be booked by 30/9/2022, and must be completed not later than 30/12/2023.  Hotel stay may be subject to certain other restrictions, including without limitation certain blackout dates, including 31/12/22. F&B Credit must be used no later than 30/10/2022 and may not be redeemed on Fridays, Saturdays or public holidays. Flight tickets is applicable for travel originating from Bangkok on Etihad Airways operated service only. Travel must commence by 31/12/2022 with other conditions apply.

Fourteen (14) days advance reservation is required and is subject to availability of rooms, and evidence of the Prize shall be presented upon booking and actual copy to be given to the property upon arrival.

The approximate retail value of the Prize is Thai Baht 287,600.  Actual value may vary based on various factors, including fluctuations in currency conversion rates, special promotions and the price for accommodations.  Except as described in the Prize, travel, ground transportation, meals, in-room or other personal charges at lodging (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, and all other expenses are NOT included in the Prize.  Hotel bookings cannot be cancelled or transferred.  Any no-shows will be credited against the Prize.  The Prize is not redeemable for other products, services or monetary value and any portion of the Prize that is not used is forfeited.  The winner will be required to provide a valid photo identification and, for any incidental charges, a credit card at the time of check-in.  Travel companion must be 21 years of age or older as of the date of check-in and may be required to provide valid photo identification.  The Prize may not be assigned or transferred and cannot be used in conjunction with any other promotions, discount or events.

Any violation of hotel’s policies, any lack or payment for hotel incidentals, or any reasonable suspicion of engagement in any illegal behavior, in Sponsor’s or hotel’s sole discretion, may result in winner’s reservation and its travel companion’s hotel reservation being cancelled and/or forfeiture of the Prize.  Any public statements disparaging, inaccurate or reflecting negatively on the Contest, Sponsor, its brand or affiliates or Prize Partner may also result in cancellation of the Prize.

RELEASE: By entering the Contest, Participants agree, to the fullest extent permitted under applicable law, to release, forever discharge and hold harmless Sponsor, King Power Mahanakhon Co., Ltd., Camden THX UK Ltd., Prize Partner, any social media outlets, each their respective affiliates, advertising and promotional agencies, and each of their respective owners, directors, officers, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, damages, losses, liabilities, injury or loss to person or property, costs and expenses, suffered by the Released Parties, arising from or relating to Participant’s participation in the Contest, Participant’s acceptance, use or misuse of the Prize (including by winner’s travel companion), or Sponsor’s use of the Entry, including, without limitation, any claims based on defamation, violation of publicity rights, privacy rights, personality rights, moral rights, or intellectual property rights, including copyright infringement and trademark infringement. 

CONDITIONS OF ENTRY: General Rules: By participating in this Contest, Participant agrees to be bound by these Official Rules and the decisions of Sponsor.  Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest, violates the Official Rules, or acts in an un-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest if it is not capable of running as planned.  Acceptance of any portion of the Prize constitutes permission to use winner’s name, likenesses and Entry (or any portion) for promotional purposes without further compensation, except where prohibited by law. 

WINNER NOTIFICATIONS: The winner will be notified within seven (7) days after the date the panel of judges has determined the winner by email, Facebook, Instagram or LINE accounts provided via the Landing Page.  Participants are responsible for notifying the Sponsor of changes in their contact information.  The winner will be required to sign and return an Affidavit of Eligibility, Publicity Release and Liability Waiver within 14 days of the date of notification or will be disqualified.  For all failures of the potential winner to respond, or undeliverable attempts, a new winner will be selected from among applicable Entries.  Prizes will be awarded within 30 days of receipt of executed affidavits.  All taxes on the Prize are the sole responsibility of the winner.  The Sponsor reserves the right to withhold taxes or other payments as it deems necessary to comply with applicable law.  The winner may be required to provide Sponsor with their tax ID number for tax purposes and shall complete any required tax forms. 

ELIMINATION: Any false information provided for the Contest by any Participant or non-compliance with these Official Rules may result in Participant’s elimination from the Contest. 

PRIVACY: Participants agree that personal data including, but not limited to, name and email address may be collected, processed, stored and otherwise used for the purposes of conducting and administering the Contest, and to verify a Participant’s identity in the event a Participant wins the Prize.  If a Participant does not provide the required data when requested, then Participant’s entry may be ineligible for the Prize.  Except as described in these Official Rules, all information provided will be maintained in accordance with the Sponsor’s Privacy Policy available at https://www.standardhotels.com/privacy.  The winner’s personal data including, but not limited to, name and email address, will be transferred to Prize Partner for the purpose of administering the Prize and will be used and maintained by Prize Partner in accordance with Prize Partner’s privacy policy, available at https://www.etihad.com/en-th/legal/privacy-policy.

INTERNET: No responsibility is assumed for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the internet, or at any website or any combination thereof.  Sponsor is also not responsible for any injury or damage to Participant’s or any other person's computer related to or resulting from participating in or downloading any materials for the Contest.  CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE LANDING PAGE OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SPONSOR BY THREATENING HOTEL STAFF OR ANY OTHER POSSIBLE REASON IS A VIOLATION OF CRIMINAL & CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to withdraw and cancel the Contest if it becomes technically corrupted (including if a computer virus or system malfunction impairs its ability to conduct the Contest) or for any other external reason, Sponsor will inform Participants accordingly.

JURISDICTION: The Contest shall be governed by and interpreted in accordance with the laws of  the Kingdom of Thailand applicable to promotions fully carried out within Thailand.  The winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.

วิธีการเข้าร่วม: ผู้เข้าร่วม (ที่ได้รับความยินยอมจากบิดามารดาหรือผู้ปกครองตามกฎหมายของตน หากเป็นผู้เยาว์) เข้าร่วมการประกวดได้ตั้งแต่วันที่  20 กรกฎาคม 2565 โดยเริ่มตั้งแต่เวลา 12:00 น. เป็นต้นไป ถึงวันที่  15 สิงหาคม 2565 ตามเวลาสากล (ICT)  (“ระยะเวลาการเปิดรับคำตอบ”)  การส่งคำตอบมีเพียงหนึ่ง (1) วิธี คือทางออนไลน์ โดยปฏิบัติตามขั้นตอนต่อไปนี้ทั้งหมดให้ครบถ้วน:

(1)        กด “ถูกใจ” และแชร์โพสต์ที่ประกาศเรื่องการประกวดโดยตั้งค่าเป็นสาธารณะ และ “แท็ก”เพื่อน 1 คนหรือมากกว่า

(2)        กดติดตาม Facebook และ Instagram ของ The Standard, Bangkok Mahanakhon และ The Standard, London ตามลิ้งค์ด้านล่าง

(5)          ส่งคำตอบเชิงสร้างสรรค์ในหัวข้อ “ให้เหตุผลว่าทำไมคุณถึงสมควรเป็นผู้ถูกเลือกที่จะได้รับทริปสุดหรูนี้?” ลงในช่องแสดงความคิดเห็นเป็นภาษาไทยหรือภาษาอังกฤษ

โดยต้องปฏิบัติตามขั้นตอนข้างต้นให้ครบทุกข้อจึงจะสามารถส่งคำตอบเข้าประกวดได้ (รวมเรียกว่า “คำตอบ” หรือ “การส่งคำตอบ”)

โดยการเข้าร่วม ผู้เข้าร่วมจะให้ข้อมูลของตนแก่ผู้สนับสนุนมิใช่ Facebook  จำกัดหนึ่ง (1) คำตอบต่อคนในระหว่างระยะเวลาการเปิดรับคำตอบ  ผู้สนับสนุนไม่รับผิดชอบต่อคำตอบที่สูญหาย เกินกำหนด ล่าช้า อ่านยาก ไม่สมบูรณ์ หรือไม่ตรงประเด็นใด ๆ  คำตอบที่ไม่สมบูรณ์ อ่านไม่ออก หรือเกินกำหนดจะถูกตัดสิทธิ 

หากผู้เข้าร่วมเลือกที่จะเข้าร่วมการประกวดโดยใช้โทรศัพท์เคลื่อนที่ของตน อาจมีค่าธรรมเนียมการใช้ข้อมูลมาตรฐาน  นอกจากเพื่อการประกาศรางวัลหรือสำหรับอีเมลส่งเสริมการขาย ผู้สนับสนุนหรือผู้ใดก็ตามที่กระทำการแทนผู้สนับสนุนจะไม่ทำการติดต่อใด ๆ กับผู้เข้าร่วมรายใดในเรื่องที่เกี่ยวกับการประกวดนี้หรือยอมรับคำตอบใด ๆ ที่ไม่เป็นไปตามเกณฑ์ข้อกำหนดสำหรับคำตอบทั้งหมดที่ระบุไว้ในที่นี้และคำตอบดังกล่าวจะถูกตัดสิทธิ  โดยการเข้าร่วมการประกวดนี้ ผู้เข้าร่วมอนุญาตโดยชัดแจ้งให้ผู้สนับสนุนติดต่อตนทางอีเมลเพื่อวัตถุประสงค์ของการประกวดนี้เท่านั้น 

บัญชี Facebook ของผู้เข้าร่วมต้องตั้งค่าเป็นสาธารณะจึงจะมีสิทธิเข้าร่วม  โดยการปฏิบัติตามขั้นตอนเกี่ยวกับโพสต์บน Facebook ข้างต้น ผู้เข้าร่วมยอมรับและตกลงว่าผู้สนับสนุนมีสิทธิในการสตรีมโพสต์ของผู้เข้าร่วมผ่าน API ของ Facebook หรือมิฉะนั้น ผ่านโพสต์ของผู้สนับสนุนดังที่กำหนดไว้ในข้อกำหนดและเงื่อนไขออนไลน์ของผู้สนับสนุนที่ https://www.facebook.com/policy.php

แต่ละคำตอบต้องเป็นไปตาม “ข้อกำหนด” ต่อไปนี้ มิฉะนั้นคำตอบจะถูกตัดสิทธิ: (i) คำตอบต้องไม่มีผู้อื่นนอกเหนือจากผู้เข้าร่วม (ii) คำตอบต้องเป็นสิ่งที่ผู้เข้าร่วมคิดขึ้นเองและไม่รวมถึงเนื้อหาใด ๆ ที่มีเจ้าของเป็นหรือถูกควบคุมโดยบุคคลภายนอก (รวมถึงแต่ไม่จำกัดเพียงเนื้อหาที่มีลิขสิทธิ์ของบุคคลภายนอก) และไม่อาจผ่านการส่งเข้าร่วมการประกวดรายการอื่นใดหรือได้รับการเสนอให้เข้าชิงรางวัลใด ๆ มาก่อน (iii) ผู้เข้าร่วมต้องให้คำอนุมัติ คำอนุญาต และการปลดเปลื้องที่เหมาะสมทั้งหมดสำหรับคำตอบเมื่อมีการร้องขอ (ในกรณีที่ผู้เข้าร่วมไม่สามารถให้การปลดเปลื้องที่จำเป็นทั้งหมดได้ ผู้สนับสนุนสงวนสิทธิ์ในการตัดสิทธิคำตอบที่เกี่ยวข้อง หรือแสวงหาเพื่อให้ได้มาซึ่งคำอนุมัติเพื่อประโยชน์ของผู้สนับสนุน หรือยอมให้คำตอบที่เกี่ยวข้องคงอยู่ในการประกวดตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว) (iv) คำตอบต้องไม่รวมถึงเนื้อหาใด ๆ ที่ลามก อนาจาร หมิ่นประมาท หรือมิฉะนั้น น่ารังเกียจหรือผิดกฎหมาย และ (v) แต่ละคำตอบต้องแตกต่างกันอย่างมีเอกลักษณ์  คำตอบใด ๆ ที่ละเมิดเกณฑ์ข้อกำหนดสำหรับคำตอบอาจถูกตัดสิทธิตามการตัดสินโดยสุจริตของผู้สนับสนุนแต่เพียงฝ่ายเดียว 

การโอนสิทธิในคำตอบที่ส่งประกวด:  ผู้เข้าร่วมยืนยันและรับรองว่า (1) ผู้สนับสนุนจะเป็นเจ้าของคำตอบ (และเนื้อหาและสิทธิทั้งปวงในสิ่งดังกล่าว); และ (2) ว่าโดยการเข้าร่วม ผู้เข้าร่วมโอนสิทธิ กรรมสิทธิ์ และผลประโยชน์ใด ๆ ทั้งหมดในคำตอบซึ่งรวมถึงแต่ไม่จำกัดเพียงสิทธิในทรัพย์สินทางปัญญาให้แก่ผู้สนับสนุนและผู้ที่ได้รับการแต่งตั้งจากผู้สนับสนุนอย่างไม่อาจเพิกถอนได้ และ (3) ว่าผู้สนับสนุนและผู้ที่ได้รับการแต่งตั้งจากผู้สนับสนุนจะมี, โดยไม่มีการจำกัด, สิทธิตลอดชีวิตในการแก้ไข ปรับแก้ ดัดแปลง เผยแพร่ หาประโยชน์ และใช้คำตอบในลักษณะใด ๆ และในสื่อใด ๆ ทั้งหมดที่เป็นที่รู้จักกันในปัจจุบันหรือที่จะถูกค้นพบหรือคิดค้นขึ้นในภายหลังทั่วโลก เพื่อวัตถุประสงค์ในการค้า การโฆษณา การส่งเสริมการขาย การประชาสัมพันธ์ และ/หรือวัตถุประสงค์อื่นทั่วโลกดังที่ผู้สนับสนุนและ/หรือผู้ที่ได้รับการแต่งตั้งจากผู้สนับสนุนอาจระบุโดยไม่มีการอนุญาตเพิ่มเติมจาก หรือการบอกกล่าวหรือการพิจารณาแก่ผู้เข้าร่วมหรือบุคคลภายนอกใด ๆ  ผู้เข้าร่วมยังตกลงว่าจะเคารพกฎกติกาอย่างเป็นทางการเหล่านี้และการตัดสินใจของผู้สนับสนุนและกรรมการซึ่งถือเป็นที่สุดและมีผลผูกพัน 

การตัดสินคำตอบที่ส่งประกวด: คำตอบที่มีสิทธิทั้งหมดที่ได้รับภายในระยะเวลาการเปิดรับคำตอบจะถูกตัดสินภายในเจ็ด (7) วัน นับจากสิ้นสุดระยะเวลาการเปิดรับคำตอบอิงตามเกณฑ์ต่อไปนี้โดยคณะกรรมการที่ได้รับการแต่งตั้งจากผู้สนับสนุนเพื่อเลือกหนึ่ง (1) คำตอบที่ได้คะแนนสูงสุดสำหรับระยะเวลาการเปิดรับคำตอบ 

เกณฑ์การตัดสิน:  ความคิดสร้างสรรค์ของคำตอบสำหรับหัวข้อ “ให้เหตุผลว่าทำไมคุณถึงสมควรเป็นผู้ถูกเลือกที่จะได้รับทริปสุดหรูนี้?” (0-100 คะแนน)

หนึ่ง (1) คำตอบ (ที่มีคะแนนรวมสูงสุดสำหรับระยะเวลาการเปิดรับคำตอบจะถือว่ามีสิทธิได้รางวัล  การชนะรางวัลขึ้นอยู่กับการตรวจสอบคุณสมบัติและการปฏิบัติตามกฎกติกาอย่างเป็นทางการเหล่านี้  ผู้สนับสนุนสงวนสิทธิ์ในการเลือกน้อยกว่าหนึ่ง (1) คำตอบสำหรับระยะเวลาการเปิดรับคำตอบตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว หากผู้สนับสนุนไม่ได้รับคำตอบที่มีสิทธิและมีคุณสมบัติจำนวนมากพอ  ในกรณีที่เสมอ กรรมการชี้ขาดอีกรายหรือคณะกรรมการชี้ขาดอีกชุดที่ผู้สนับสนุนระบุตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียวจะตัดสินคำตอบที่เสมอกันใหม่โดยอิงตามเกณฑ์การตัดสินข้างต้น

ผู้ชนะหรือบิดามารดาหรือผู้ปกครองตามกฎหมายของผู้ชนะแต่ละรายจะได้รับการติดต่อผ่านทางบัญชี Facebook Instagram Line และ/หรือ อีเมลของตนที่ให้ไว้ในแบบการส่งคำตอบและอาจจำเป็นต้องลงนามและส่งคืนเอกสารใด ๆ ที่ผู้สนับสนุนร้องขอภายในสาม (3) วันของวันที่มีการบอกกล่าว  ในกรณีที่ไม่ปฏิบัติตามกฎกติกาอย่างเป็นทางการเหล่านี้ เมื่อมีการระบุว่าผู้มีสิทธิชนะรายใดไม่กรอกและส่งเอกสารที่ระบุไว้ข้างต้นอย่างเหมาะสม ผู้สนับสนุนอาจตัดสิทธิผู้มีสิทธิชนะดังกล่าวและผู้เข้าร่วมอีกรายอาจได้รับบอกกล่าวว่าผู้เข้าร่วมรายดังกล่าวคือผู้มีสิทธิชนะรางวัลตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว 

 

คำอธิบายและเงื่อนไขของรางวัล:  แพ็คเกจรางวัลสำหรับ (1) หนึ่งผู้ชนะประกอบไปด้วย (“รางวัล”)

·      ตั๋วเครื่องบินไป-กลับสายการบิน Etihad ชั้น Business โดยมีจุดหมายปลายทางจากกรุงเทพฯ ประเทศไทย ถึงกรุงลอนดอน ประเทศอังกฤษ สำหรับผู้ชนะและผู้ติดตามที่เป็นผู้ใหญ่หนึ่งราย (“ตั๋วเครื่องบิน”)

·      บัตรกำนัลสำหรับพัก 3 คืนที่เดอะ สแตนดาร์ด, ลอนดอน สำหรับผู้ชนะและผู้ติดตามที่เป็นผู้ใหญ่อีกหนึ่งรายในห้อง สแตนดาร์ด คิง อ็อฟ คิง (ห้องสำหรับสองคน) ผู้สนับสนุนจะพยายามจัดให้ผู้ชนะได้เข้าพักในวันที่ต้องการ แต่รายละเอียดของการเข้าพักดังกล่าวทั้งหมดจะเป็นไปตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว

·      เครดิตแทนเงินสดในการใช้จ่ายเพื่อรับประทานอาหารและเครื่องดื่มในห้องอาหารต่างๆที่ เดอะ สแตนดาร์ด, แบงค็อก มหานคร (“เครดิตแทนเงินสด”)

การจองห้องพักของโรงแรมต้องทำภายในวันที่ 30/9/2565 และต้องเสร็จสมบูรณ์ไม่ช้ากว่าวันที่ 30/12/2566 การเข้าพักที่โรงแรมอาจมีข้อจำกัดบางประการ ซึ่งรวมถึงวันที่ไม่สามารถใช้สิทธิได้ต่างๆรวมไปถึงวันที่ 31/12/2565 เครดิตแทนเงินสดสามารถใช้ได้ไม่เกินวันที่ 30/10/2565 และไม่สามารถใช้ได้ในวันศุกร์ วันเสาร์ และวันหยุดนักขัตฤกษ์ ตั๋วเครื่องบินสามารถใช้ได้กับการเดินทางที่กำเนิดขึ้นจากกรุงเทพฯผ่านการบริการของสายการบิน Etihad เท่านั้น การเดินทางจำต้องเกิดขึ้นภายใน 31/12/2565 และอาจมีข้อจำกัดบางประการ

การสำรองห้องพักจะต้องทำล่วงหน้าสิบสี่ (14) วัน และขึ้นอยู่กับห้องว่างที่พร้อมให้บริการ และต้องแสดงหลักฐานการรับรางวัลขณะทำการจองและส่งมอบสำเนาฉบับจริงให้แก่ที่พักเมื่อไปถึง

มูลค่าค้าปลีกโดยประมาณของรางวัลคือ 287,600 บาทไทยหรือ 6,566 ปอนด์อังกฤษ  มูลค่าจริงอาจแตกต่างออกไปตามปัจจัยที่หลากหลาย ซึ่งรวมถึงความผันผวนของอัตราแลกเปลี่ยนสกุลเงิน รายการส่งเสริมการขายพิเศษ และค่าที่พัก  ค่าตั๋วเครื่องบินหรือการเดินทางทางอื่น การขนส่งทางบก อาหาร บริการในห้องพัก หรือค่าใช้จ่ายส่วนตัวอื่น ๆ ขณะเข้าพัก (เช่น มินิบาร์ ภาพยนตร์) ค่าโทรศัพท์ เงินบำเหน็จ ค่าใช้จ่ายจิปาถะ และค่าใช้จ่ายอื่น ๆ ทั้งหมดไม่รวมอยู่ในรางวัล  รายการจองโรงแรมไม่สามารถยกเลิกหรือเปลี่ยนมือได้  การจองแต่ไม่เข้าพักใด ๆ จะถูกหักจากรางวัล  รางวัลไม่สามารถแลกเปลี่ยนเป็นผลิตภัณฑ์ บริการ หรือมูลค่าทางการเงินอื่นได้ และส่วนใด ๆ ของรางวัลที่ไม่ได้ใช้จะถูกริบ  ผู้ชนะแต่ละรายจะต้องแสดงเอกสารระบุตัวตนที่มีรูปถ่ายที่สมบูรณ์ตามกฎหมายและบัตรเครดิตสำหรับค่าใช้จ่ายจิปาถะใด ๆ  ณ เวลาที่ลงทะเบียนเข้าพัก  ผู้ติดตามต้องมีอายุ 21 ปีขึ้นไป ณ วันที่ลงทะเบียนเข้าพักและอาจต้องแสดงเอกสารระบุตัวตนที่มีรูปถ่ายที่สมบูรณ์ตามกฎหมาย  รางวัลไม่อาจโอนหรือเปลี่ยนมือได้และไม่สามารถใช้ร่วมกับรายการส่งเสริมการขาย ส่วนลด หรือกิจกรรมอื่นใด

การละเมิดนโยบายของโรงแรมใด ๆ การไม่ชำระเงินค่าใช้จ่ายจิปาถะในโรงแรมใด ๆ หรือการมีเหตุควรสงสัยว่ามีส่วนเกี่ยวข้องในพฤติกรรมที่ผิดกฎหมายใด ๆ อาจนำไปสู่ยกเลิกการสำรองห้องพักของผู้ชนะและการสำรองห้องพักโรงแรมของผู้ติดตามและ/หรือการริบรางวัลตามดุลยพินิจของผู้สนับสนุนหรือโรงแรมแต่เพียงฝ่ายเดียว  การเผยแพร่ข้อความสาธารณะใด ๆ ที่เป็นการดูหมิ่น ไม่ถูกต้อง หรือสะท้อนด้านลบเกี่ยวกับโรงแรม ผู้สนับสนุน หรือตราสินค้าของผู้สนับสนุนหรือบริษัทในเครืออาจนำไปสู่การยกเลิกรางวัล

การอนุญาตปลดเปลื้อง โดยการเข้าร่วมการประกวด ผู้เข้าร่วมตกลงที่จะอนุญาตปลดเปลื้องจำหน่ายอย่างถาวร และปกป้องผู้สนับสนุน King Power Mahanakhon Co., Ltd Camden THX UK Ltd. พันธมิตรรางวัล และช่องทางสื่อสังคมออนไลน์ใด ๆ (รวมถึง Facebook) และบริษัทในเครือต่าง ๆ ของผู้สนับสนุน เจ้าของโรงแรม และช่องทางสื่อสังคมออนไลน์ดังกล่าว ตัวแทนด้านโฆษณาและส่งเสริมการขาย และเจ้าของ กรรมการ พนักงาน ลูกจ้าง ตัวแทน และผู้แทนแต่ละราย (รวมเรียกว่า “ผู้ที่ได้รับการอนุญาตปลดเปลื้อง”) จากและต่อข้อเรียกร้อง ความเสียหาย ความสูญเสีย ความรับผิด การบาดเจ็บหรือการสูญเสียต่อบุคคลและทรัพย์สิน ต้นทุนและค่าใช้จ่ายที่เกิดขึ้นต่อผู้ที่ได้รับการปลดเปลื้องที่เกิดขึ้นจากหรือเกี่ยวข้องกับการเข้าร่วมในการประกวดของผู้เข้าร่วม การรับ การใช้หรือการใช้รางวัลในทางที่ผิดของผู้เข้าร่วม (รวมถึงโดยผู้ติดตามของผู้ชนะ) หรือการใช้คำตอบของผู้สนับสนุน ซึ่งรวมถึงแต่ไม่จำกัดเพียงข้อเรียกร้องฐานหมิ่นประมาท การละเมิดสิทธิในชื่อเสียง สิทธิความเป็นส่วนตัว สิทธิส่วนบุคคล ธรรมสิทธิ์ หรือสิทธิในทรัพย์สินทางปัญญาใด ๆ ซึ่งรวมถึงการละเมิดลิขสิทธิ์และการละเมิดเครื่องหมายทางการค้าตามขอบเขตสูงสุดที่กฎหมายที่เกี่ยวข้องอนุญาต

เงื่อนไขในการส่งคำตอบ: กฎกติกาทั่วไป: โดยการเข้าร่วมในการประกวดนี้ ผู้เข้าร่วมตกลงที่จะถูกผูกพันโดยกฎกติกาอย่างเป็นทางการเหล่านี้และการตัดสินของผู้สนับสนุน  ผู้สนับสนุนสงวนสิทธิ์ในการตัดสิทธิผู้ใดก็ตามที่แทรกแซงหรือพยายามแทรกแซงกระบวนการส่งคำตอบหรือการดำเนินการประกวด ละเมิดกฎกติกาอย่างเป็นทางการ หรือกระทำการในลักษณะที่ไม่มีน้ำใจนักกีฬาหรือก้าวร้าวหรือโดยมีเจตนาก่อความรำคาญ ดูหมิ่น ข่มขู่ หรือคุกคามบุคคลอื่นใดตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว  ผู้สนับสนุนสงวนสิทธิ์ในการยกเลิก ยุติ ดัดแปลง หรือระงับการประกวดตามดุลยพินิจของผู้สนับสนุนแต่เพียงฝ่ายเดียว หากไม่สามารถดำเนินการตามแผนที่วางไว้ได้  การรับส่วนใดส่วนหนึ่งของรางวัลถือเป็นการอนุญาตให้ใช้ชื่อ การกดถูกใจ และคำตอบ (หรือส่วนใดก็ตาม) ของผู้ชนะ เพื่อวัตถุประสงค์ในการส่งเสริมการขายโดยไม่มีค่าตอบแทนเพิ่มเติม ยกเว้นในกรณีที่ต้องห้ามตามกฎหมาย 

การบอกกล่าวผู้ชนะ: ผู้ชนะแต่ละรายจะได้รับการบอกกล่าวภายในเจ็ด (7) วัน หลังจากวันที่คณะกรรมการระบุผู้ชนะทางอีเมล บัญชี Facebook Instagram และ/หรือ บัญชี Line ผู้เข้าร่วมมีหน้าที่รับผิดชอบในการบอกกล่าวให้ผู้สนับสนุนทราบถึงการเปลี่ยนแปลงในข้อมูลการติดต่อของตน  ผู้ชนะจะต้องลงนามและส่งคืนหนังสือรับรองคุณสมบัติ การประชาสัมพันธ์ และการปลดเปลื้องความรับผิดภายใน 14 วันของวันที่มีการบอกกล่าว มิฉะนั้นจะถูกตัดสิทธิ  หากไม่มีการตอบรับจากผู้มีสิทธิชนะหรือไม่สามารถติดต่อผู้ชนะได้ไม่ว่าในกรณีใด ๆ ผู้ชนะรายใหม่จะได้รับเลือกจากในบรรดาคำตอบที่เข้าเกณฑ์  การมอบรางวัลจะมีขึ้นภายใน 30 วันของการรับหนังสือรับรองที่ลงนาม  ภาษีทั้งหมดที่เกิดจากรางวัลเป็นความรับผิดชอบของผู้ชนะแต่ละรายแต่เพียงฝ่ายเดียว  ผู้สนับสนุนสงวนสิทธิ์ในการหักภาษี ณ ที่จ่ายหรือค่าธรรมเนียมอื่นตามที่เห็นว่าจำเป็นเพื่อปฏิบัติตามกฎหมายที่เกี่ยวข้อง  ผู้ชนะแต่ละรายจะต้องแจ้งให้ผู้สนับสนุนทราบหมายเลขประกันสังคมของตนเพื่อวัตถุประสงค์ทางด้านภาษีและกรอกแบบภาษีใด ๆ ที่จำเป็น  

การคัดออก: การให้ข้อมูลเท็จใด ๆ สำหรับการประกวดของผู้เข้าร่วมรายใดก็ตามหรือการไม่ปฏิบัติตามกฎกติกาอย่างเป็นทางการเหล่านี้อาจนำไปสู่การคัดผู้เข้าร่วมออกจากการประกวด 

ความเป็นส่วนตัว: ผู้เข้าร่วมตกลงว่าข้อมูลส่วนบุคคลซึ่งรวมถึงแต่ไม่จำกัดเพียงชื่อและที่อยู่อีเมลอาจถูกรวบรวม ประมวลผล จัดเก็บ และใช้งานในทางอื่นใดเพื่อวัตถุประสงค์ในการดำเนินการและบริหารจัดการการประกวดและเพื่อพิสูจน์ตัวตนของผู้เข้าร่วมในกรณีที่ผู้เข้าร่วมชนะรางวัล  หากผู้เข้าร่วมไม่ให้ข้อมูลที่กำหนดเมื่อมีการร้องขอ คำตอบของผู้เข้าร่วมจะไม่มีสิทธิได้รับรางวัล  ยกเว้นตามที่ระบุไว้ในกฎกติกาอย่างเป็นทางการเหล่านี้ ข้อมูลทั้งหมดที่ให้ไว้จะถูกเก็บรักษาตามนโยบายความเป็นส่วนตัวของผู้สนับสนุนซึ่งสามารถหาดูได้ที่ https://www.standardhotels.com/privacy ข้อมูลส่วนตัวของผู้ชนะรางวัลซึ่งรวมถึงแต่ไม่จำกัดเพียงชื่อและที่อยู่อีเมล จะถูกนำส่งไปที่พันธมิตรรางวัลเพื่อวัตถุประสงค์ในการดำเนินการ จัดเก็บ และบริหารจัดการการประกวดข้อมูลทั้งหมดที่ให้ไว้จะถูกเก็บรักษาตามนโยบายความเป็นส่วนตัวของพันธมิตรรางวัลซึ่งสามารถหาดูได้ที่ https://www.etihad.com/en-th/legal/privacy-policy

อินเทอร์เน็ต: ไม่มีการรับผิดชอบต่อข้อผิดพลาด การละเว้น การสะดุดหยุดลง การลบ ข้อบกพร่อง ความล่าช้าในการดำเนินการหรือการส่ง , การขโมยหรือการทำลายหรือการเข้าถึงที่ไม่ได้รับอนุญาตหรือการปรับเปลี่ยนซึ่งเนื้อหาของคำตอบ หรือสำหรับการขัดข้องทางเทคนิค เครือข่าย อุปกรณ์โทรศัพท์ ทางอิเล็กทรอนิกส์ คอมพิวเตอร์ ฮาร์ดแวร์ หรือซอฟต์แวร์ไม่ว่าในลักษณะใด หรือการส่งข้อมูลคำตอบที่ไม่ถูกต้องหรือการที่ผู้สนับสนุนไม่ได้รับข้อมูลคำตอบอันเกิดจากปัญหาทางเทคนิคหรือสภาวะคอขวดในการรับส่งข้อมูลบนอินเทอร์เน็ต หรือที่เว็บไซต์ใด ๆ หรือการรวมกันใด ๆ ของสิ่งดังกล่าว  นอกจากนี้ ผู้สนับสนุนไม่รับผิดชอบต่อการบาดเจ็บหรือความเสียหายต่อคอมพิวเตอร์ของผู้เข้าร่วมหรือของบุคคลอื่นใดที่เกี่ยวข้องกับหรือที่เกิดขึ้นจากการเข้าร่วมในหรือการดาวน์โหลดเนื้อหาใด ๆ สำหรับการประกวด  ข้อควรระวัง: ความพยายามใด ๆ ของผู้เข้าร่วมในการสร้างความเสียหายแก่หน้าเพจหรือเว็บไซต์ของผู้สนับสนุนโดยเจตนาหรือบ่อนทำลายการดำเนินการที่ชอบด้วยกฎหมายของผู้สนับสนุนโดยการข่มขู่พนักงานโรงแรมหรือเหตุผลอื่นใดที่เป็นไปได้เป็นการละเมิดกฎหมายอาญาและแพ่ง  หากมีการกระทำความพยายามดังกล่าว ผู้สนับสนุนสงวนสิทธิ์ในการตัดสิทธิและเรียกร้องค่าเสียหายจากผู้เข้าร่วมรายใดดังกล่าวตามขอบเขตสูงสุดที่กฎหมายอนุญาต ผู้สนับสนุนสงวนสิทธิ์ในการเพิกถอนและยกเลิกการประกวด หากเกิดปัญหาทางเทคนิค (รวมถึงหากไวรัสคอมพิวเตอร์หรือการขัดข้องของระบบทำให้ผู้สนับสนุนไม่สามารถจัดการประกวดได้) หรือด้วยเหตุผลภายนอกอื่นใด ซึ่งทางผู้สนับสนุนจะแจ้งให้กับผู้ประกวดได้ทราบดังกล่าว

เขตอำนาจ: การประกวดจะอยู่ภายใต้และถูกตีความตามกฎหมายแห่งราชอาณาจักรไทยที่เกี่ยวข้องกับรายการส่งเสริมการขายที่มีการดำเนินการทั้งหมดภายในประเทศไทย ผู้ชนะแต่ละรายตกลงว่าความไม่สมบูรณ์และสภาพบังคับใช้ได้ของส่วนใดส่วนหนึ่งของเอกสารใด ๆ จะไม่ส่งผลต่อความสมบูรณ์หรือสภาพบังคับใช้ได้ของส่วนใด ๆ ที่เหลือของเอกสารดังกล่าวไม่ว่าโดยทางใด
